Jobaroo Terms and Conditions

Welcome to Jobaroo!

These Terms and Conditions (“Terms”) govern your access to and use of the Jobaroo mobile application and website (collectively, the “Platform”), owned and operated by Jobaroo (Pty) Ltd (“Jobaroo”, “we”, “us”, or “our”).

By creating an account or by accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to these Terms, you may not use the Platform.

1. Definitions

  • “User”: Any person who accesses or uses the Platform. A User can act as a Client, a Service Provider, or both.
  • “Client”: A User who uses the Platform to search for, connect with, or hire a Service Provider.
  • “Service Provider”: A User who uses the Platform to list their skills, offer services, and apply for jobs.
  • “Connection Fee”: The fee of R69.00 ZAR paid by a Client to unlock the contact details of a Service Provider.
  • “Verification Fee”: The recurring subscription fee paid by a Service Provider to obtain “Verified” status on their profile.
  • “Content”: Any text, graphics, images, music, software, audio, video, information, or other materials posted, generated, provided, or otherwise made available through the Platform.

2. The Jobaroo Service

Jobaroo is an online platform that acts as a venue to connect Clients with Service Providers. Users can switch between Client and Service Provider roles within a single account.

IMPORTANT: Jobaroo’s Role is Limited. Jobaroo is not a party to any contract or agreement entered into between a Client and a Service Provider. We are not an employment agency, broker, or employer. We do not hire, supervise, or control the work of Service Providers. We are not responsible for the conduct of any User, the quality of the work performed, or the payment for said work. Any disputes between Users must be resolved directly between them.

3. Eligibility and Account Registration

  • You must be at least 18 years old to use the Platform.
  • You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
  • You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • You may not impersonate someone else or create an account for anyone other than yourself without permission.

4. User Obligations and Conduct

4.1. All Users Agree Not To:

  • Violate any applicable South African or international law or regulation.
  • Post any Content that is false, fraudulent, defamatory, hateful, obscene, or discriminatory.
  • Use the Platform for any purpose other than its intended use, including spamming, phishing, or distributing malware.
  • Scrape, copy, or otherwise collect information about other Users without their consent.
  • Infringe upon the intellectual property rights of Jobaroo or any third party.

4.2. Service Provider Obligations:

  • Accurately represent your skills, qualifications, experience, and any licenses you hold.
  • Maintain the confidentiality of Client information.
  • Respond to job applications and Client inquiries in a professional manner.
  • If you subscribe to the “Verified” status, you agree to the recurring Verification Fee and consent to undergo a verification process by our designated third-party partner.

4.3. Client Obligations:

  • Post clear, accurate, and non-misleading descriptions of the jobs or projects you require.
  • Use the Service Provider’s contact details obtained through the Connection Fee solely for the purpose of discussing the potential project and for no other reason.
  • Pay Service Providers for completed work as per your separate, direct agreement with them.

5. Fees and Payments

  • For Clients (Connection Fee): To access a Service Provider’s contact details, Clients must pay a non-refundable Connection Fee of R69.00 ZAR, subject to the terms outlined in our Refund Policy.
  • For Service Providers (Verification Fee): Service Providers may choose to subscribe to our “Verified” status for a recurring monthly fee. This fee will be billed in advance on a recurring basis. You may cancel your subscription at any time, but fees paid for the current billing cycle are non-refundable.
  • Third-Party Payment Processor: All payments are processed through a secure third-party payment gateway. Jobaroo does not store your full credit card or banking details.
  • Taxes: All Users are solely responsible for determining their own tax-reporting requirements and for remitting all applicable taxes (e.g., Income Tax, VAT) to the relevant authorities.

6. Content and Intellectual Property

  • User Content: You retain ownership of all Content you post on the Platform. However, by posting Content, you grant Jobaroo a worldwide, non-exclusive, royalty-free, transferable license to use, host, display, reproduce, modify, and distribute your Content in connection with operating and promoting the Platform.
  • Jobaroo IP: The Platform and all its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Jobaroo and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Disclaimers and Limitation of Liability

  • The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. Jobaroo makes no warranties, expressed or implied, regarding the reliability, safety, or quality of the services provided by Service Providers.
  • We conduct a verification process for “Verified” providers but do not otherwise perform background checks on Users. We do not guarantee the truth or accuracy of any User Content or the identity of any User.
  • To the fullest extent permitted by applicable law, Jobaroo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform, including any defamatory, offensive, or illegal conduct of other Users or third parties; or (iii) any disputes between you and another User.
  • In no event shall Jobaroo’s aggregate liability for all claims relating to the Platform exceed the greater of R1000 ZAR or the amount of fees you paid to Jobaroo in the 6 months prior to the event giving rise to the liability.

8. Indemnification

You agree to defend, indemnify, and hold harmless Jobaroo, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from your use of the Platform, your violation of these Terms, or your dispute with another User.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. You may terminate your account at any time by following the instructions within the app.

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled in the courts of Cape Town, Western Cape.

12. General Provisions

  • Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days’ notice before any new terms take effect. By continuing to use the Platform after those revisions become effective, you agree to be bound by the revised terms.
  • Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Jobaroo regarding our Platform.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
